Terms and conditions.
These terms govern the free entry of a club in the Bontem directory and its management.
1. Scope
These general terms and conditions (T&C) apply to the free entry of a club in the club directory operated by Bontem and to the management of that entry. No account is required for the entry; management is handled via a management link (magic link) delivered by email.
They do not apply to merely browsing the directory, nor to login-free registrations for events or membership enquiries. Anyone who registers or enquires does not enter into a contract with Bontem; how we handle that information is set out in the privacy policy.
These T&C likewise do not apply to any paid Bontem offering; for those, separate terms are agreed before activation.
2. Bontem's service
Bontem provides the club with a free, publicly visible entry in the directory. This includes in particular:
- a public club profile with description, contact details and location,
- the publication of the club's upcoming public events,
- the receipt of login-free registrations and membership enquiries and their forwarding to the club for its own confirmation,
- the upkeep of the entry via the management link, without a password.
Bontem continuously develops the directory further and may adjust the scope of functions.
3. Management link instead of an account
The entry is managed via a magic link sent to the club email address provided during the entry. Anyone with access to this email address can edit the entry or have it deleted. The club keeps this address up to date and treats the management link as confidential.
4. The club's responsibility for content
- The person making the entry warrants that they are authorised to list the club and to publish the information.
- The information must be kept truthful, up to date and not misleading.
- The club is responsible for all contents of the entry (texts, logo, contact details, location, events), including the necessary rights and compliance with data protection obligations towards named persons.
- Login-free registrations and membership enquiries are forwarded to the club. The club is responsible for the further processing of this data.
5. Rights in the content
The club grants Bontem the non-exclusive, royalty-free and territorially unlimited right to store, reproduce, make publicly available and display the content belonging to the entry (texts, logo, images, event details) within the scope of the directory, including in overviews, previews, search results and machine-readable interfaces. This right ends with the deletion of the entry; backups already created and third-party caches remain unaffected.
All other rights remain with the club. Bontem claims no rights in the club's name, logo or content, and does not use them for purposes other than operating the directory.
6. Prohibited use, reporting and removal
In particular, false entries, listing third-party clubs without authorisation, unlawful or misleading content, and any use that disrupts operation or is abusive are prohibited. Bontem is entitled to block or remove entries or content that breach these T&C or applicable law.
Anyone who notices a faulty or abusive entry can report it via the report function on the respective club page. Bontem reviews incoming reports and takes appropriate measures where necessary.
7. Availability and liability
The directory is provided free of charge and without any guarantee of uninterrupted availability. Bontem is liable only for damage based on intentional or grossly negligent conduct. Liability for slight negligence, for indirect damage, lost profit or data loss is excluded to the extent permitted by law.
8. Deletion of the entry and discontinuation of the service
The club can amend its entry at any time via the management link or have it deleted. On request, Bontem also removes the entry upon a request sent to the contact address stated in the legal notice. With deletion, the entry is no longer shown publicly.
Bontem may discontinue the free directory in whole or in part. The club will be informed of this with reasonable advance notice at the club email address on file.
9. Changes to the T&C
Bontem may amend these T&C. We announce material changes in advance at the club email address on file. The version published on this page at the relevant time is authoritative. Anyone who does not agree with a change can have the entry deleted at any time (section 8); by continuing to use the directory after a change, the amended terms are deemed accepted.
10. Final provisions and place of jurisdiction
Should individual provisions of these T&C be invalid, the validity of the remaining provisions remains unaffected. Swiss law applies exclusively, to the exclusion of conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction is Lachen, Switzerland, unless mandatory statutory provisions provide for another place of jurisdiction.
